Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

Our Services

PrimeAlign provides web design, marketing automation, and related digital services for service-based businesses including but not limited to:

Custom website design and development
Search engine optimization (SEO)
Marketing automation and CRM setup
Review generation and reputation management
Missed call text-back systems
Database reactivation campaigns
Ongoing website hosting and maintenance

All services are subject to availability and the terms outlined in your individual service agreement.

Service Estimates and Pricing

Pricing and service details will be discussed during your strategy call and outlined in your service agreement. Monthly subscription services are billed on a recurring basis. We will communicate any changes to pricing with advance notice.

Payment Terms

Payment terms will be outlined in your service agreement. Subscriptions are billed monthly unless otherwise agreed upon. Clients are responsible for keeping payment information current and ensuring timely payment of all invoices.

Client Responsibilities

To ensure timely and successful delivery of our services, clients agree to:

Provide accurate business information and content for their website
Respond to requests for information and approvals in a timely manner
Provide access to necessary accounts (Google My Business, domain registrar, etc.) as needed
Review and approve deliverables within the agreed-upon timeframes

SMS / Text Messaging Terms

By opting in to receive text messages from PrimeAlign, you acknowledge and agree to the following terms:

You consent to receive text messages from PrimeAlign at the phone number you provided. These messages may include appointment confirmations, project updates, follow-up communications, and service-related information.
Message frequency varies. You may receive up to 10 messages per month depending on your level of interaction with our services.
Message and data rates may apply. Please consult your mobile carrier for details about your text messaging plan.
You may opt out at any time by texting STOP to (587) 326-3672. You will receive a single confirmation and no further messages will be sent.

Your consent to receive text messages is not required as a condition of purchasing any goods or services.
PrimeAlign will never sell, rent, or share your phone number or opt-in data with third parties for marketing purposes.
You must be 18 years of age or older to opt in to receive text messages from PrimeAlign.
Carriers are not liable for delayed or undelivered messages.

Intellectual Property

Upon full payment, clients receive ownership of custom website designs and content created specifically for their project. PrimeAlign retains the right to showcase completed projects in our portfolio unless otherwise agreed in writing. All proprietary systems, templates, automations, and processes remain the intellectual property of PrimeAlign.

Website Hosting and Maintenance

Websites built by PrimeAlign are hosted as part of our monthly service. If a client discontinues their subscription, we will provide reasonable time to migrate their website to another hosting provider. We are not responsible for website functionality after migration to a third-party host.

Limitation of Liability

PrimeAlign's total liability for any claim arising from our services shall not exceed the total amount paid by the client in the twelve (12) months preceding the claim. We are not liable for:

Indirect, incidental, or consequential damages
Loss of revenue or business opportunities
Actions or decisions of third-party platforms (Google, hosting providers, etc.)
Results from marketing campaigns, as outcomes depend on many external factors
Delays caused by factors beyond our control

Cancellation and Refunds

Cancellation terms are outlined in your service agreement. Generally, monthly subscriptions may be cancelled with 30 days written notice. We do not offer refunds for services already rendered or for partial months of service.

Website Use

Our website is provided for informational purposes. You agree not to:

Use the website for any unlawful purpose
Attempt to gain unauthorized access to our systems
Interfere with the proper functioning of the website
Copy or reproduce website content without permission

Dispute Resolution

We are committed to resolving any concerns promptly and fairly. If you have a complaint or dispute regarding our services, please contact us directly. We will work with you to find a reasonable resolution before pursuing any formal proceedings.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services constitutes acceptance of any changes.

Governing Law

These Terms of Service are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the courts of Alberta.
